At a High Court hearing on petitions concerning the investigation into the leak of a video allegedly showing Israeli guards abusing a Palestinian detainee, the attorney general’s representative said that Justice Minister Yariv Levin “acted without authority” when he appointed retired judge Asher Kula to lead the probe.
“The decision to appoint Kula has no real legal standing,” the representative argued. “The only person authorized to appoint a prosecutor is the attorney general.”
The judge said that “a campaign of pressure has been exerted against the Israel Police” and called the issue “dramatic.”

Last week, Attorney General Gali Baharav-Miara said that she will no longer be involved in matters concerning the investigation of the leak of the video of the alleged abuse at the Sde Teiman detention center, but that Justice Minister Yariv Levin had no right to independently appoint someone to head the investigation.
In a letter she sent to Levin, Baharav-Miara wrote that Levin’s appointment of judicial ombudsman Asher Kula, a retired judge, as being in charge of the investigation is an abuse of his authority and improper interference in criminal proceedings.
After Levin announced his appointment, Kula asked the police to provide him with the materials from the investigation into the leak of a video in the Sde Teiman prisoner abuse case.

Kula said he was authorized to do so in light of the letter of appointment Levin issued, and no reason existed to wait for a ruling by the High Court of Justice.
After a consultation between senior police commanders, Police Chief Danny Levy decided not to honor Kula’s request until the High Court ruled on the issue.
